Subdivision of land comes under the control provisions of the Environmental Planning and Assessment Act. Once development consent (planning) has been obtained for a land subdivision (if required by the Gundagai Local Environmental Plan 2011), a Subdivision Certificate must be obtained with certification by Council staff of plan of subdivision prepared by your land surveyor.

Strata subdivisions also require development approval and also an approval under the Strata Schemes (Freehold Development) Act 1973 or the Strata Schemes (Leasehold Development) Act 1986.  A Strata Certificate may be issued by the Gundagai Shire Council or, where the development consent (planning) for strata subdivision was granted after 1 June 2000, a private accredited certifier in certain circumstances.

Proposed Subdivision must have consideration to existing land use patterns, environmental factors, serviceability, access options and sustainability.

 

Minimum Lot Sizes

Rural residential subdivision is accommodated for on land zoned R5 Large Lot Residential and selectively on land zoned RU4 Primary Production Small Lots.  Generally minimum lot sizes are 1ha and 10ha respectively. 

Urban residential subdivision has a minimum lot size requirement of 1500m2 in general and varies. 

Rural subdivision has a minimum lot size requirement of 40ha.

Advertising of Proposals

Development applications for subdivisions to create more lots need to be advertised to allow for neighbours to comment before being approved by the Council.  Council officers are available to assist with the preparation of your application for Subdivision.
